Terms of Use.

1. Acceptance of Terms

Digipet is made by Steven Becerra, an individual based in California (“we”, “us”). These Terms of Use are an agreement between you (“You” or “Your”) and Steven Becerra. By accessing and using the Digipet app, website, and related services (together, “Digipet”), you agree to be bound by them. If you do not agree to these terms, please do not use Digipet.

2. Who Can Use Digipet

You must be at least 13 years old to use Digipet. If you’re under 18, you may use Digipet only with the permission of a parent or guardian who agrees to these Terms on your behalf. By signing in, you confirm that you meet these requirements.

3. Your Account

To play Digipet, you need to sign in with an emailed code, Google, or Apple. Keep your account information accurate and your sign-in secure, and don’t share your account. You’re responsible for what happens under it. You can delete your account at any time from Account.

4. Pets and AI-Generated Content

Digipet uses artificial intelligence to generate pets, their personalities, images, and 3D models, and to write what pets say, to you and to each other. Generated content is written as it happens and can be inaccurate, unexpected, or unlike what you asked for. Pets who follow the news talk about it in their own words and may get details wrong. Nothing a pet says is advice, and you shouldn’t rely on it.

AI also checks the pictures you upload and the words you describe a print or rug with, writes each print’s and rug’s name and description, and draws the prints and rugs you describe. A check can refuse something harmless, and a drawing may not look like what you described. If a print or rug fails to build, its tokens are returned.

To the extent permitted by applicable law, we do not claim ownership of the AI-generated pictures, names, or descriptions created for your prints and rugs. As between you and us, you may use, reproduce, modify, and share these outputs, including for commercial purposes, subject to these Terms and applicable law. This does not guarantee that an output is eligible for copyright protection, that you own exclusive rights in it, or that it does not infringe another person’s rights. AI-generated outputs may be similar or identical to outputs generated for other users, and we do not guarantee that any output will be unique. You grant us the license to these outputs described in section 7, to the extent you hold rights in them.

5. Tokens

• Tokens let you use features of Digipet, such as buying bling in the Shop and building prints and rugs.
• Tokens are free: you receive tokens when you first sign in and can earn more, for example with a daily reward. Tokens can’t be bought.
• Tokens have no cash value. They can’t be sold, transferred to another account, or exchanged for money or anything else outside Digipet.
• We may change how tokens are earned, what features cost, and which features exist. We may correct a balance that is wrong because of an error or misuse.
• Tokens are lost when your account is deleted or terminated.

6. Gifts and Invites

• You can gift a friend a piece you bought in the Shop, or a copy of your own print or rug that you buy with tokens for the gift, by sending them a link. The first signed-in player to take it from the link gets it, so send it only to the person it’s for.
• Until a gift is taken, you can take it back. A gift that isn’t taken within 14 days comes back to you. A copy you bought to gift stays yours if it comes back; its tokens aren’t returned.
• You can send up to 10 gifts each calendar month (UTC); a gift you take back, or one that comes back unclaimed, doesn’t count. A gift you receive, and the free bling you start with, can’t be gifted on.
• Once a friend takes a gift, it’s theirs, even if you later delete the piece or your account. A copy of your print or rug carries your picture.
• We may remove a gift from the friend who took it if it breaks these Terms, or if we must for a legal or safety reason.
• A new player can use a friend’s invite code, typed in or through an invite link, once, within 7 days of joining. When they first collect the daily visit 7 days in a row, the friend who invited them earns the tokens shown on the app’s Invite tab. Up to 10 friends earn you tokens in a calendar month (UTC); any more are paid in the months after.
• Gifts and invite rewards have no cash value and can’t be sold or traded. Invites are for real friends: don’t make accounts, or use anyone else’s, to earn rewards. We may withhold or take back rewards, and gifts, that come from abuse.

7. Your Content

You keep the rights you have in what you add to Digipet: the names, personalities, and topics you write for your pets, the pictures you upload for prints and rugs, and the words you describe a print or rug with (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and adapt Your Content to run Digipet, including sending it to our AI providers to check it, name it, and draw from it, building it into prints and rugs, and showing it to the people you share it with, such as a friend you gift a copy to. This license ends when you delete your account, except for copies in backups that expire on their own, copies you’ve gifted that a friend has taken, and what we must keep to comply with the law, resolve disputes, or prevent abuse, as our Privacy Policy describes.

You confirm that you own, or have permission to use, every picture you upload and everything in it, including artwork, logos, and characters made by others, and that photos of other people are shared with their permission.

8. Community Rules

Digipet has zero tolerance for objectionable content and abusive users. Don’t create, upload, describe, or try to get a pet to say anything that:

• is sexually explicit, or exploits or endangers children;
• is hateful, harasses or bullies anyone, or threatens violence;
• promotes self-harm, illegal activity, or dangerous behavior;
• shares someone’s personal information, impersonates someone, or infringes anyone’s rights;
• is spam or misleading.

Don’t try to manipulate the AI into producing content like this, including by wording a print or rug to get past our checks, and don’t abuse other players.

You can report a print or rug a friend gifted you from inside Digipet, or send us a message. Where you see another player’s pets, you can block their owner, and undo it in Account › Blocked owners. We review reports within 24 hours. When content or a user breaks these rules, we remove the content and may suspend or permanently remove the account responsible, without notice.

9. Acceptable Use

You agree not to use Digipet in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms. Don’t copy, scrape, or reverse engineer Digipet, use bots or automation, interfere with its servers, or exploit bugs, including to gain tokens. Respect the intellectual property rights of others.

10. Intellectual Property

Apart from Your Content and the pictures drawn for you (section 4), all rights, title, and interest in and to Digipet and its contents, including its worlds, characters, bling, and software, are and will remain the exclusive property of Steven Becerra and his licensors. You may share screenshots and videos of your pets for personal, non-commercial purposes.

11. Privacy Policy

Your use of Digipet is also governed by our Privacy Policy, which is incorporated herein by reference.

12. Third-Party Services and the App Store

Signing in with Google or Apple, and the services that run Digipet, are subject to their own terms. If you downloaded the app from Apple’s App Store, these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for the app, and Apple’s Licensed Application End User License Agreement also applies to your use of it.

13. Availability and Changes

Digipet is provided “as is” and “as available”. We may change, pause, or remove worlds, pets, bling, and features, and Digipet may sometimes be unavailable.

14. Limitation of Liability

To the maximum extent permitted by law, Steven Becerra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Where the law allows a limit, our total liability to you for any claim about Digipet is limited to the greater of $100 or what you paid us in the 12 months before the claim. Nothing in these Terms excludes or limits liability that can’t be excluded or limited under applicable law.

15. Amendments to Terms

We reserve the right to modify these terms at any time. We’ll update the date at the top, and tell you in the app or by email about changes that matter. Your continued use of Digipet after any such changes constitutes your acceptance of the new terms.

16. Termination

You may stop using Digipet and delete your account at any time. We may suspend or terminate your access to Digipet if you break these Terms, if the law requires it, or to protect other players or Digipet, without prior notice where the law allows. We may also end your access, or Digipet itself, for other reasons with reasonable notice.

17. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or Digipet will be resolved in the state or federal courts located in California, and you and Steven Becerra consent to their jurisdiction.
